Contractor Availability Is Different From Permission to Alter Leased Space

Finding an available concrete provider does not settle who may authorize alterations in a leased building. Before scheduling work, separate the technical inquiry, site-access permission and authority to approve the proposed scope. This avoids turning a convenient appointment into an unreviewed property change.

Start with the property’s approval process

Ask the appropriate owner, manager or adviser which documents govern the proposed work and who must review it. This is a project coordination step, not a general interpretation of a lease. A tenant’s permission to admit someone for a visit may be different from authority to order removal, drilling, coating or changes to shared areas.

Describe the proposed disturbance

Provide the actual scope for review, including affected areas and interfaces, rather than only the contractor’s name. EPA’s remodeling guidance notes that disturbing existing materials can introduce additional concerns. Relevant material and specialist reviews should occur through the responsible project team. Do not treat approval of a price as proof that every required authorization or precaution is complete.

Confirm the release before mobilization

Keep the accepted scope, authorized approver and any conditions together. Ask the provider how changes will be paused and reviewed if the work differs from what was approved. Availability can remain provisional while that decision is resolved. A clear handoff lets the contractor know what is authorized without asking the contractor to decide a private ownership or lease dispute.

Worked example

Illustrative example: a fictional shop tenant obtains a repair appointment but has not yet secured the property manager’s scope approval. The tenant keeps mobilization provisional and supplies the proposed work for review. Contractor availability is not presented as permission to alter the shared entrance.
